Do I pay for past from relationship AFTER a break up??
When my ex boyfriend and I started dating, he got a 1 year memebership to a gym in our area. Since I went with him, he put me on the membership as a spouse. He paid for the membership and all the contract and payments are in his name; I was only on the contracts as the spouse. That was in Sept 2005. We broke up in October of 2006. He called me today (2007) stating that the gym payments when in default and on his credit report and I owed him for half the payment. I never knew anything about the payments nor if he was still paying on it because he NEVER mentioned it. Now that we have broke up and we both have moved on, he is trying to come back in my life attempting to charge me for things he did for me when we were dating. He also wants to take me to small claims court for $100 of the defaulted gym payment. I didn’t even know I owed anything. Am I liable for paying this or anything he is charging me for while we were dating?
As long as the contract is soley in his name and you never signed the contract, you would not be liable.
Even if it were joint and your name was on it, if he had been paying all along and cannot provide any proof that he ever asked you to pay your "share" during the course of the year contract he would likely not meet his due diligence requirement. As the contract was only for 1 year, he most likely would have had to renew it without your knowledge or consent and above all, signature. Even so, if he ever expected you to pay a portion, he would need to provide proof of that prior to him defaulting on the payments now.
In this case though, he would not have legal grounds nor would it be to his benefit to try to sue you in Court because he perpetrated a fraud on the gym by representing you as his spouse when you were not.

He commited fraud you were nevr married,
if you knew about it you also commited fraud,
if he signed it then he attested that you are or were married.
Contact the gym and tell them you were never married and that he told you when you were dating that he was paying for your membership.
or pay the money, I would not want to go to court on this both of you could get charged with crimes.

There would have a had to be a contract with you for you to pay the bill or half of the bill, You clearly state that there was no meeting of the minds (contract). You owe him nothing and don’t be bullied into thinking that you do. Make sure that you make no agreement to pay him or even to acknowledge the debt as being yours because you never know when you are being taped. Good luck don’t worry about it.

is there proof you USED the membership? you didnt sign the contract. he did give it to you as a "gift" and didnt expect you to pay for it while you were together. dont think he has a pot to P in.

I don’t know for sure, but I think that since he was the contracted individual, then he is responsible for the payments, if he likes it or not. He put you on only as a person that could use the gym under his membership. But I would consult someone legally to find out for sure. The gym might be able to tell you if they hold you responsible for the past due payments or not, and how are you legally obligated for the past due balance, if at all. But I think that from the explanation that you gave, he is the person that held the membership, and you were just someone he allowed to use the gym on his membership. Most gyms allow that for its members.
